Welcome to Whisper, a multiplayer/co-op horror game owned and operated by JugPanda Studios LLC. These Terms of Service (“Terms”) govern your access to and use of Whisper, including the website at playwhisper.com, the game, accounts, multiplayer features, online services, purchases, events, rewards, and any related services we provide together as the “Service.”
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Whisper is a browser-first horror game that may also be available through native mobile builds, app stores, testing programs, or other platforms. The Service may include gameplay, multiplayer/co-op rooms, profiles, friends or social features, progression, achievements, cosmetic items, virtual currency, events, challenges, online backend services, and other related features.
Whisper may include horror themes, darkness, tension, jump scares, audio and visual effects, and online interactions with other players. Use your judgment before playing, especially if you are sensitive to horror, flashing effects, intense audio, or stressful gameplay.
We may add, remove, test, modify, disable, rebalance, or discontinue features at any time, including online features, gameplay systems, events, virtual items, rewards, and platform-specific functionality.
You must be legally allowed to use the Service in your location.
If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian. By using the Service, you confirm that you meet these eligibility requirements or have the required permission.
We may restrict access to certain features, purchases, multiplayer functionality, testing programs, or platform builds based on age, region, platform rules, account status, or legal requirements.
Some features may require an account. You agree to provide accurate information when creating or using an account and to keep your account information reasonably up to date.
You may not sell, share, transfer, rent, or give away your account unless we expressly allow it in writing.
We are not responsible for losses caused by unauthorized account access if you failed to protect your account credentials or devices.
You agree not to access or use another person’s account without permission. You also agree not to bypass login, authentication, security, moderation, anti-cheat, rate-limiting, payment, or access-control systems.
We may investigate suspected cheating, fraud, abuse, unauthorized access, account compromise, or security issues. We may take action to protect the Service, other players, and our systems, including limiting, suspending, or terminating access.
Whisper may include online multiplayer, co-op rooms, social features, display names, profiles, friend interactions, messages, player identifiers, matchmaking, events, or similar features.

If you discover a bug, vulnerability, payment issue, reward exploit, or security issue, report it through playwhisper.com/support and do not exploit or publicly disclose it.
The Service may allow you to provide or display content, including display names, profile information, messages, social interactions, room names, friend activity, gameplay-related content, feedback, or other materials (“User Content”).
You keep any rights you have in your User Content. However, by submitting or using User Content in the Service, you grant JugPanda Studios LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, perform, transmit, modify, adapt, and use that User Content as reasonably needed to operate, improve, promote, moderate, and support the Service.
This license does not give us ownership of your User Content. It allows us to run the Service and display your User Content where you choose to use social or gameplay features.
You represent that you have the rights needed to provide your User Content and that your User Content does not violate these Terms, applicable law, or anyone else’s rights.
We may remove, hide, restrict, edit, or disable access to User Content at any time if we believe it violates these Terms, creates risk, affects the player experience, or may expose us or others to liability.
If you send us ideas, suggestions, bug reports, balance feedback, feature requests, concepts, or other feedback about Whisper or the Service, you agree that we may use that feedback without restriction or compensation to you.
You are not required to send feedback. If you do, you understand that we may already be working on similar ideas or may develop similar features independently.
The Service may include virtual currency, cosmetic items, unlocks, achievements, progression, rewards, event items, passes, challenges, or similar digital content.
Unless we clearly state otherwise, virtual currency and virtual items:
We may adjust gameplay systems, reward rates, item availability, progression, cosmetics, events, challenges, or virtual economies to operate, balance, test, improve, or protect the Service.
We do not guarantee that any virtual item, currency, reward, cosmetic, achievement, event, challenge, pass, or feature will remain available forever.
The Service may allow purchases through the web, payment providers, app stores, platform stores, or other approved payment methods. Web purchases may be handled by third-party payment providers. Mobile or platform purchases may be handled by the applicable app store or platform.
Prices, availability, taxes, fees, payment methods, refund options, and purchase rules may vary by platform, region, product, and time.
By making a purchase, you agree to pay the listed price and any applicable taxes, fees, or charges. You also agree to the payment terms of the applicable payment provider, app store, or platform.
Unless required by law or stated otherwise at the time of purchase, purchases for virtual currency, digital items, cosmetics, passes, rewards, or other digital content are final once delivered or made available.
Refunds are subject to applicable law and the rules of the payment provider, app store, or platform used for the purchase. If you believe there is a billing issue, contact us through playwhisper.com/support.
We may restrict, suspend, or terminate accounts involved in payment fraud, chargeback abuse, unauthorized transactions, refund abuse, or other payment-related misconduct.
The Service may offer subscriptions, passes, battle-pass-style features, event access, seasonal rewards, limited-time challenges, premium features, or similar offerings.
Specific terms, duration, renewal rules, cancellation rules, included benefits, expiration dates, and platform-specific conditions will be provided where applicable. If there is a conflict between these Terms and specific purchase terms shown at the time of purchase, the more specific purchase terms control for that purchase.
We may modify, replace, or discontinue events, passes, subscriptions, reward tracks, challenges, or limited-time features, subject to applicable law and any specific purchase terms.
Your use of the Service is also governed by our Privacy Policy, available at playwhisper.com/privacy.
The Privacy Policy explains how we collect, use, store, and share information related to the Service.
By using the Service, you acknowledge that we will handle your information as described in the Privacy Policy.
You may request account deletion through playwhisper.com/account-deletion.
Account deletion may permanently remove or disable access to account data, progress, virtual items, purchases, social features, and other account-linked content, subject to applicable law, fraud-prevention obligations, security needs, payment records, legal requirements, and technical limitations.
Deleting your account does not automatically cancel third-party subscriptions, app store subscriptions, payment-provider arrangements, or platform-level accounts. You are responsible for managing those through the applicable provider or platform.
We may provide updates, patches, fixes, balance changes, new features, test features, content changes, or service changes. Some updates may be required to continue using the Service.
We may change, suspend, limit, or discontinue all or part of the Service at any time, including multiplayer features, online rooms, events, rewards, virtual items, purchases, platform builds, or account features.
We are not required to support old versions of the Service or maintain compatibility with all devices, browsers, operating systems, webviews, app stores, or hardware configurations.
We may suspend, restrict, or terminate your access to the Service, your account, or specific features if we believe that:

You may stop using the Service at any time. Certain sections of these Terms will continue to apply after your access ends, including sections about intellectual property, purchases, disclaimers, limitation of liability, indemnity, governing law, and dispute-related provisions.
Whisper, the Service, and all related code, game systems, designs, artwork, audio, music, sound effects, characters, names, logos, branding, user interface, levels, text, content, animations, features, and technology are owned by JugPanda Studios LLC or its licensors.
These Terms give you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Service for your own entertainment, subject to these Terms.
You may not copy, distribute, sell, rent, sublicense, publicly perform, publicly display, modify, reverse engineer, create derivative works from, or commercially exploit any part of the Service except as expressly allowed by these Terms or by written permission from JugPanda Studios LLC.
All rights not expressly granted to you are reserved by JugPanda Studios LLC and its licensors.
The Service may rely on or interact with third-party services, including hosting providers, authentication providers, database providers, payment processors, analytics or backend tools, app stores, platform stores, testing platforms, device operating systems, and other service providers.
Your use of those third-party services may be subject to their own terms, policies, fees, restrictions, and privacy practices. We are not responsible for third-party services, platforms, outages, payment processing rules, store review decisions, store availability, or third-party account issues.
Platform-specific versions of Whisper may include different features, limitations, payment options, microphone availability, or online functionality depending on the platform, store rules, testing status, technical requirements, or release stage.
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, JugPanda Studios LLC disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation.

To the maximum extent permitted by law, JugPanda Studios LLC and its owners, officers, employees, contractors, agents, partners, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, service interruption, device issues, account loss, virtual item loss, or loss of access to online features.

Venue and jurisdiction should be confirmed by qualified counsel before publication, especially if JugPanda Studios LLC uses a different principal place of business, operates under different state requirements, or needs a different dispute-resolution structure.
Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
We may update these Terms from time to time. When we do, we will update the effective date above and may provide additional notice where appropriate.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
